How to send a notice

If you believe material on VisoLab infringes a copyright you own, email the agent above. Your notice must include:

1. your physical or electronic signature (you, or a person authorized to act for the owner)

2. a description of the copyrighted work you say is infringed (or a list, if one notice covers several works)

3. the link or other location of the material, with enough detail for us to find it

4. your name, address, phone number and email

5. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law

6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner

A notice that leaves out these items may not be acted on. For trademark or other complaints, use the same address and tell us what right you claim.

False notices. Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing can be liable for damages.

What we do

- We remove or disable access to the material that a complete notice identifies, and tell the person who posted it.

- We may keep a copy of the notice and the material while a counter-notice or a dispute is open.

- Canada. Where a notice meets the notice-and-notice rules of Canada's Copyright Act, we forward it to the person concerned and keep records as the Act requires.

Counter-notice

If we removed your material and you believe that was a mistake or a misidentification, email the agent above. Your counter-notice must include:

1. your physical or electronic signature

2. a description of the removed material and where it appeared before removal

3. a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification

4. your name, address and phone number

5. a statement that you consent to the jurisdiction of the US Federal District Court for the district where your address is. If your address is outside the United States, you consent to the jurisdiction of any judicial district where we may be found.

6. a statement that you will accept service of process from the person who sent the original notice or their agent

What happens next. We send your counter-notice to the person who complained and tell them we will restore the material. We restore it no fewer than 10 and no more than 14 business days after we receive your counter-notice, unless that person tells us first that they have started a court action against you.

Repeat infringers

Repeat infringers: we terminate, in appropriate circumstances, the accounts of users who are repeat infringers (17 U.S.C. §512(i)(1)(A)). We count notices that were not successfully countered. We may close an account sooner for a serious infringement, and we may restore an account where a notice is withdrawn or found to be mistaken.
